These Terms of Service (the “Terms”) govern your access to and use of enhancemyphoto.net and the AI photo enhancement services made available under the Enhance My Photo brand (collectively, the “Service”). In these Terms, “Enhance My Photo,” “we,” “us,” and “our” refer to the operator of the Service, and “you” refers to the person or organization using the Service.

Please read these Terms before using the Service.

1. Accepting these Terms and eligibility

By creating an account, purchasing a subscription or credits, uploading a photo, or otherwise accessing or using the Service, you confirm that you have read and agree to these Terms. If you do not agree, do not use the Service.

You must have the legal capacity required to enter into these Terms where you live. If applicable law requires permission from a parent, guardian, or other authorized person, that person must review and accept these Terms and is responsible for your use of the Service. If you use the Service for an organization, you confirm that you have authority to bind that organization.

2. The Service, accounts, and guest use

Enhance My Photo provides AI-assisted photo enhancement. Available processing modes, export options, usage limits, processing routes, and paid benefits may vary by plan, account status, location, capacity, and current product configuration. We may add, change, limit, or discontinue features when reasonably necessary to operate or improve the Service.

Some features require an account. You agree to provide accurate information, keep your credentials confidential, and promptly contact us if you believe an account has been used without authorization. You may not share an account, access another person's account without permission, or create or coordinate accounts to evade usage limits or enforcement measures.

The Service may offer limited guest use. Guest access is tied to a temporary browser or device session and does not provide the same history or recovery features as a registered account. Refreshing or leaving the page, clearing browser data, changing devices, or sharing a guest link may permanently remove your ability to access a guest task or result, even if processing continues.

3. Your photos and the processing license

You retain the rights you hold in photos and other material you submit to the Service (“User Content”). We do not acquire ownership of User Content merely because you upload or process it.

You grant us a limited, non-exclusive, worldwide, royalty-free license, with the right to permit necessary service providers to act on our behalf, to host, store, copy, transmit, reformat, transform, and process User Content only as reasonably needed to provide, operate, secure, troubleshoot, and support the Service and deliver the result you request. This license lasts only for as long as the relevant processing or retention is permitted under our Privacy Policy, applicable purchase terms, and law.

You represent that you own User Content or have all permissions required to upload and process it. This includes any copyright, privacy, publicity, and other permissions required for identifiable people or third-party material in the photo.

Our Privacy Policy explains how information is handled. These Terms do not create a separate authorization or promise concerning the use of User Content for model training.

4. Enhanced results and permitted use

As between you and Enhance My Photo, we do not claim ownership of an enhanced result derived from your User Content. To the extent you hold the necessary rights and applicable law permits, you may use that result for lawful personal or commercial purposes.

AI-assisted results may be inaccurate, distorted, incomplete, or similar to results produced for other users. They are not guaranteed to be unique. The Service does not grant you rights in third-party copyrights, trademarks, likenesses, privacy rights, or other protected material that may appear in an input or result. You are responsible for reviewing a result and obtaining any permissions or making any disclosures required before publishing, selling, or otherwise relying on it.

5. Acceptable use

You may not use the Service, directly or indirectly, to:

• upload or process sexual, pornographic, sexually explicit, or sexually suggestive content;
• upload or process any sexual content involving a minor, or content that exploits, sexualizes, or endangers a minor;
• create or distribute non-consensual intimate imagery or sexualized content;
• upload or process content that is illegal, infringing, defamatory, threatening, harassing, hateful, or that you do not have the right to use;
• impersonate, deceive, defraud, or harm another person, including through face-swap or deepfake content or a manipulated identity document;
• violate another person's privacy, publicity, biometric, or data-protection rights;
• introduce malware or harmful code, attack or probe the Service, test its security without authorization, or interfere with another user's access;
• reverse engineer, decompile, extract, or attempt to discover non-public source code, models, safeguards, or processing methods except where law expressly allows it;
• use unauthorized bots, scrapers, or other automated means to access the Service, or bypass access controls, rate limits, credit charges, or usage quotas;
• share, sell, sublicense, or provide access to the Service itself as a competing or white-label service without our written permission; or
• help another person do any of the above.

Our Acceptable Use Policy provides additional detail and forms part of these Terms. These restrictions do not prohibit lawful, identity-preserving restoration or enhancement of a photo you have the right to use.

We may refuse processing, restrict access, or remove content when we reasonably believe these Terms or applicable law have been violated. We may preserve or report information when required by applicable law, but we do not promise to review every item of User Content.

6. Subscriptions, credits, and payments

Current prices, taxes, included benefits, credit allocations, and expiration terms are shown before purchase. Charges are quoted and processed in United States dollars (USD), and applicable taxes may be calculated at checkout. By starting a purchase, you authorize us and our payment provider to charge the payment method you select.

Monthly and yearly subscriptions renew automatically until canceled. You may request cancellation from Billing Settings. Cancellation takes effect on the date shown in the product, and access generally continues through the paid period unless the Service states otherwise or law requires a different result.

Daily credits reset on a UTC-day basis and do not roll over. Monthly subscription credits may roll over for no more than one additional subscription cycle. A credit pack expires on the date or after the period shown before purchase; some packs may be offered without a scheduled expiration. The terms shown for a particular grant or purchase control if they are more specific. Credits are access units, not money or stored value, and may not be transferred or redeemed for cash except where applicable law requires otherwise.

We may change future prices, plans, credit allocations, or benefits. We will provide reasonable notice of a material change affecting a recurring paid plan before the change applies to a future renewal when required by law.

7. Task credit returns and payment refunds

The Service may automatically return task credits when a task fails or is canceled in an eligible state. Once processing has begun, leaving the page, deleting a task, deciding not to use a result, or being dissatisfied with an AI result does not normally return the credits used for that task. The task status and refund information shown in the product govern the applicable task-credit handling.

Under our Refund Policy, you may request a refund for an initial or automatically renewed monthly or yearly subscription payment within 72 hours (3 days) after successful payment if you have used no more than 50 subscription credits associated with that payment. Exactly 50 credits meets the usage condition. Each payment is assessed separately; credits already returned for failed tasks, free credits, and separately purchased credit-pack credits are excluded from that payment's subscription usage. Continued use after a request may affect eligibility. Subscription requests outside these conditions and separately purchased credit packs are normally non-refundable, subject to the exceptions below.

For an eligible and approved ordinary subscription refund, we may deduct a fee of up to 6% of the relevant order's original paid amount, where permitted by applicable law and payment rules. The review outcome states the actual fee and refund amount. Approved refunds are processed through the original payment channel, and arrival time depends on the payment provider and bank.

We separately review duplicate charges, unauthorized payments, verified failures to deliver the purchased Service, and refunds required by law for both subscriptions and credit packs. These cases are not excluded by the ordinary request period, usage limit, or credit-pack restriction; their refund amounts and any deductions follow applicable requirements.

To request review, contact support@enhancemyphoto.net with your account email, order number, payment date, and reason for the request. Do not send full payment-card information. Submitting a request does not mean a refund is approved or a subscription is canceled. Canceling a subscription does not automatically refund a payment. Use Billing Settings to stop future renewals.

When an approved subscription refund is processed, we withdraw the associated credits and subscription benefits. If a partial refund, reversal, or payment dispute is confirmed, we may adjust the corresponding credits, benefits, or account access to prevent duplicate value. Task credit returns are separate from payment refunds and do not prevent a request under the Refund Policy. Changes to these refund terms do not retroactively reduce rights already held for existing orders. Nothing in this section limits consumer rights that cannot be waived by contract.

8. Privacy and third-party services

Our Privacy Policy describes how we process account, photo, task, billing, analytics, and support information. The Service relies on third parties for functions such as payment processing, storage, email, and AI processing. Their terms and privacy notices may apply to their processing.

Internet transmission, third-party processing, and electronic storage cannot be guaranteed to be completely secure or continuously available. You should keep an original copy of important photos and download results you wish to retain.

9. Enhance My Photo intellectual property

The Service, including its software, interface, design, documentation, brand, and platform technology, is owned by or licensed to Enhance My Photo and is protected by applicable intellectual-property laws. These Terms give you a limited, non-exclusive, non-transferable, revocable right to access and use the Service in accordance with your plan and these Terms. They do not transfer ownership of the Service or any third-party technology to you.

10. Suspension, termination, and stopping use

You may stop using the Service at any time. Stopping use, deleting a photo or task, and canceling a subscription are separate actions; you must cancel a recurring subscription through Billing Settings to stop future renewals.

We may restrict, suspend, or terminate access when reasonably necessary to address a violation of these Terms, fraud, non-payment, a payment dispute, security risk, legal obligation, or material harm to the Service or another person. We will provide notice when reasonably practicable, but may act immediately where delay would increase risk.

When access ends, your ability to use the Service and retrieve content may end. The treatment of unused credits or paid benefits remains subject to the terms shown at purchase, Section 7, and applicable law. Provisions that by their nature should survive, including provisions about rights, payment obligations, disclaimers, liability, and disputes, will survive termination.

11. Disclaimers and limitation of liability

To the maximum extent permitted by law, the Service is provided “as is” and “as available.” We disclaim implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranty that the Service will be uninterrupted, error-free, completely secure, or produce a particular result. You are responsible for deciding whether a result is appropriate for your intended use.

To the maximum extent permitted by law, Enhance My Photo and its service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, business, goodwill, data, or opportunities arising from the Service. Our total aggregate liability for claims relating to the Service or these Terms will not exceed the amount you actually paid for the Service during the 12 months immediately before the event giving rise to the claim.

These exclusions and limits do not apply to liability that cannot lawfully be excluded or limited, including where applicable liability for fraud, willful misconduct, or death or personal injury caused by negligence. Some jurisdictions do not allow certain exclusions, so part of this section may not apply to you. We are not responsible for delay or failure caused by events beyond our reasonable control.

12. Changes, disputes, language, and contact

We may update these Terms as the Service or applicable requirements change. We will post the updated Terms and revise the “Last updated” date. For material changes, we will provide reasonable notice through the Service, on the website, or by email where appropriate. If you do not agree to an updated version, you must stop using the Service before it takes effect.

Before starting formal proceedings, please contact support@enhancemyphoto.net and give us a reasonable opportunity to resolve the issue. These Terms are governed by the laws that apply to the relationship between you and the operator of Enhance My Photo, without limiting any mandatory consumer protection available to you. A dispute that cannot be resolved informally may be brought before a court that has jurisdiction under applicable law.

The English and Chinese versions of these Terms are intended to have the same meaning. Neither version automatically overrides the other; any difference should be interpreted in a way that best reconciles both versions and applicable mandatory law.

These Terms, the Privacy Policy, the Refund Policy, and any purchase-specific terms shown to you form the agreement governing the Service. If one provision is unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver of it.
